Theme

Deuteronomy 19 pairs asylum for the accidental manslayer (the woodcutter whose axe-head flies loose) against extradition for the deliberate hater, adds the landmark law, then turns to courtroom safeguards — the two/three-witness rule, the malicious-witness procedure, and the talion formula as a judicial ceiling, not vengeance.

Translation & textual notes

The MT of Deuteronomy 19 is well preserved; LXX and SP track it closely, with only minor pluses/orthographic variants (e.g., the defective spelling הָאֵל for 'these' at v. 11, an orthographic curiosity, not a different word, paralleled at Gen 19:8; Lev 18:27). The chapter's three-cities law (vv. 1-13) sits in an intentional relationship with Num 35:9-34 and with Deut 4:41-43: the latter names Moses' provisional Transjordan cities before the conquest, while ch. 19 legislates the three cities 'in the midst of your land' (v. 2) proper, plus a never-historically-realized conditional expansion to six (vv. 8-9) tied to border enlargement AND covenant obedience — a standing, unfulfilled conditional rather than a later editorial layer, pace some source-critical proposals. The talion formula (v. 21) closely parallels Exod 21:23-25 and Lev 24:19-20; the versions render it near-identically, and its function here is explicitly judicial — a fixed ceiling on court-administered penalty for a convicted false witness (v. 19's זָמַם), not a warrant for private vengeance, which the chapter elsewhere (vv. 6, 12-13) works hard to restrain.
